1. Acceptance of Terms

By accessing or using FarmWise AI ("the App"), you agree to these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the App.

2. Description of Service

FarmWise AI is an AI-powered agricultural assistant application that provides:

• Crop Disease Diagnosis: AI-based analysis of crop images to identify potential diseases, pest damage, and nutrient deficiencies.
• Weather Forecasting: Localized weather data and AI-generated farming recommendations.
• Market Price Information: Commodity price data and trend analysis.
• AI Farming Assistant: Text and voice-based AI advisor for agricultural questions.

3. Important Disclaimer

• AI diagnoses may not always be accurate. Always verify critical diagnoses with a qualified professional before taking action.
• Treatment recommendations (both organic and chemical) are general suggestions. Follow local regulations and product labels when applying any treatments.
• Weather forecasts are based on third-party data and may not be 100% accurate.
• Market price data is for reference only and may not reflect real-time prices at your local market.

4. User Responsibilities

As a user of FarmWise AI, you agree to:

• Use the App only for lawful purposes related to farming and agriculture.
• Provide accurate information about your crops and farming conditions.
• Not rely solely on AI-generated diagnoses for critical crop management decisions.
• Follow all applicable local, state, and national regulations regarding pesticide use, chemical treatments, and farming practices.
• Not attempt to reverse-engineer, decompile, or disassemble the App.
• Not use the App to transmit harmful, offensive, or illegal content.

5. Subscriptions and Payments

5.1 Free and Premium Features

FarmWise AI offers both free features and a premium subscription ("FarmWise Pro") that unlocks additional functionality.

5.2 Subscription Plans

• Weekly: $1.99 per week (includes a 3-day free trial)
• Monthly: $4.99 per month
• Annual: $29.99 per year (includes a 7-day free trial)

5.3 Payment and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• Free trial periods, if offered, will automatically convert to a paid subscription unless canceled before the trial ends.

5.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your Apple ID account settings:

• Go to Settings > [Your Name] > Subscriptions on your iOS device.
• Select FarmWise AI and choose "Cancel Subscription."
• Cancellation takes effect at the end of the current billing period.

6. Intellectual Property

• The App, including its design, features, code, and content, is owned by the developer and protected by intellectual property laws.
• You retain ownership of any photos you take or upload. By using the diagnosis feature, you grant us a limited, non-exclusive license to process your images for AI analysis purposes only.
• AI-generated content (diagnoses, advice, tips) is provided for your personal use and may not be commercially redistributed without permission.

7. Limitation of Liability

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated diagnoses or recommendations.
• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

8. AI Data Privacy & No Data Collection for Training

• No data is sent to or collected by any third-party AI model (including GPT, OpenAI, or any other large language model) for training, fine-tuning, or model improvement purposes.
• Your crop images, chat messages, and any other data submitted through the App are processed solely to provide you with real-time responses (diagnoses, advice, etc.) and are not stored, retained, or used by the AI service provider after the response is generated.
• We do not share, sell, or transfer your personal data or usage data to any AI company for the purpose of training or improving their AI models.
• All AI processing is performed through secure, enterprise-grade API endpoints with data processing agreements that explicitly prohibit the use of customer data for model training.
• Farm logs and diagnosis records are stored locally on your device using on-device storage and are never uploaded to external servers unless you explicitly initiate an AI analysis.

9. Service Availability

• We strive to maintain the App's availability but do not guarantee uninterrupted service.
• AI features require an internet connection and depend on third-party cloud services which may experience downtime.
• We reserve the right to modify, suspend, or discontinue any feature of the App at any time.

10. Termination

We reserve the right to terminate or suspend your access to the App if you violate these Terms of Use. Upon termination:

• Your right to use the App ceases immediately.
• Data stored locally on your device will remain until you delete the App.
• Active subscriptions will not be refunded for the remaining period unless required by applicable law.

11. Changes to Terms

We may modify these Terms of Use at any time. Material changes will be communicated through the App or by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
